The High Court on Thursday rejected a petition filed by BNP Chairperson Khaleda Zia seeking bail on health and humanitarian grounds in the Zia Charitable Trust case.
The court passed the rejection order based on a report by Bangabandhu Sheikh Mujib Medical University (BSMMU), which said it is possible to provide advanced treatment to Khaleda Zia at BSMMU.
The HC said that the report prepared by a seven-member medical board of BSMMU has stated that Khaleda did not give her consent to get advanced treatment.
“The BSMMU report didn’t acknowledge that the medical board was not competent to provide advance treatment to Khaleda Zia. And since the board is competent and she is a convicted person so there is no scope to give her the opportunity for treatment other than the jail code,” said the court in its ruling.
The HC bench of Justice Obaidul Hassan and Justice AKM Zahirul Huq passed the order after hearing the fresh bail petition.
Khaleda Zia has been ailing from different health complications, including diabetes, hypertension, asthma and arthritis. Her diabetes, hypertension and asthma are now under control, the judge said citing the report.
The BSMMU submitted the report on Khaleda’s medical treatment to the HC as per its earlier order.
Following a fresh bail petition, this High Court bench last February 23, wanted to know the latest health condition of BNP chairperson Khaleda Zia’s treatment. Complying with the court order the BSMMU authorities submitted the report on Wednesday. And the court held hearing on the report on Thursday.
Barrister Moudud Ahmed, Advocate Zainul Abedin and Barrister AM Mahbub Uddin Khokan took part in the hearing on behalf of Khaleda Zia, Advocate Khurshid Alam Khan appeared for the Anti-Corruption Corruption (ACC) and Attorney General Mahbubey Alam appeared for the state.
BNP Chairperson Khaleda Zia filed a fresh bail petition with the High Court in the case on February 18 this year on health ground.
A special court in Dhaka on October 29, 2018, convicted Khaleda in connection with the Zia Charitable Trust case and sentenced her to seven-year rigorous imprisonment.
On November 18, 2018, Khaleda Zia filed an appeal with the High Court challenging the lower court verdict and sought acquittal in the case. At the same time she filed a bail petition in the case, which was rejected by the same HC bench on July 31, 2018.
Then she moved to the appellate division and the apex court on December 12, 2019, rejected her bail petition in the case.
The apex court asked the medical board of the BSMMU to provide Khaleda Zia with advance biological treatment with her consent after rejecting a bail petition in the case.
A six-member bench of the Appellate Division headed by Chief Justice Syed Mahmud Hossain passed the order after dismissing her petition with observations.
The Anti-Corruption Commission filed the Zia Charitable Trust case against Khaleda, Harris, Ziaul and Monirul with Tejgaon police on August 8, 2011.
Khaleda Zia landed in jail on February 8, 2018, after a Dhaka court sentenced her to five years imprisonment in Zia Orphanage Trust case. The High Court on October 30 of the same year enhanced the punishment of Khaleda Zia to 10 years imprisonment in this case.
