The government has appealed to the Appellate Division seeking for a stay on the High Court order that granted bail to BNP acting secretary general Mirza Fakhrul Islam.
The Chamber Judge of the Appellate Division on Monday sent a petition filed by the state seeking a stay order against the permanent bail granted by the High Court to BNP acting secretary general Mirza Fakhrul Islam Alamgir in three cases of violence to the full bench of the division for hearing.
Chamber Judge Justice Hasan Foez Siddique sent the petition to the full bench, headed by Chief Justice SK Sinha, fixing Thursday for hearing.
On June 18, the HC granted bail to the BNP leader in three cases of violence – two of the cases were filed with Paltan Police Station while another with Motijheel Police Station.
On June 21, an HC bench comprising Justice M Rezaul Haque and Justice M Khasruzzaman granted an interim bail to Mirza Fakhrul Islam Alamgir in three more violence cases filed with Paltan Police Station, paving the path for his release from jail.
The court also issued a rule asking the government why Fakhrul would not be granted permanent bail in the three cases.
On April 16, Mirza Fakhrul secured six months’ High Court bail in another case filed with Paltan Police Station on January 4 for allegedly carrying out arson and vandalism. On January 6, plain-clothes police picked Fakhrul up as he came out of the Jatiya Press Club following BNP’s announcement to observe January-5 as ‘Democracy Killing Day’.
The BNP leader is now facing 79 cases.
