The High Court (HC) on Monday fixed March 27 to pass further order on the bail petition filed by Ruhul Amin, the main accused of gang-rape to a mother of four in Noakhali’s Subarnachar area for voting “sheaf of paddy” in the 11th general elections.
The HC Bench of Justice Mamnoon Rahman and Justice S M Kuddus Zaman passed the order after considering a time prayer filed by a counsellor of Ruhul Amin.
The lawyer said, Ruhul Amin’s main counselor was in abroad. So, they needed time for hearing.
Then the court fixed March 27 for passing further order on the matter.
Then the Attorney General Mahbubey Alam said the court, “Ruhul Amin’s lawyer, Advocate Ashek-e-Rasul, submitted the bail petition suppressing the facts. And it is contempt of court as per law. So, the court can consider his position as contempt of court.”
Then the court said, they will hear the appeal on the deferred day.
On March 18, the High Court granted anticipatory bail for one year to Ruhul Amin.
Ruhul Amin was the Publicity Affairs Secretary of Subarnachar Awami League. He was expelled from the party after being accused of rape. He was the former member of Char Jubilee Union Parishad.
Later, the government lawyers informed the court that Ruhul Amin’s lawyer misguided the court in granting the bail. After this, the concerned HC Bench recalled the bail order on March 23, even the day was a vacation day for the High Court.
Deputy Attorney General Biswajit Roy, the government lawyer for the concerned High Court Bench, said, “In the hearing, Ruhul Amin’s lawyer told the court that his client’s name was not in the FIR of the case. And the case was still under investigation. On March 21, we informed the court about the order. Then the court recalled the order at an emergency basis.”
A mother of four was gang-raped in Noakhali’s Subarnachar on December 31, 2018, allegedly by 10 to 12 Awami League activists. The 35-year-old woman claimed that she was raped for voting for “sheaf of paddy”, the electoral symbol of the BNP, during December 30 national polls. The rape incident sparked widespread criticism across the country. Police arrested 10, including Ruhul Amin, in that case.
