Fakhrul’s bail in 3 cases extended

The Supreme Court has cautioned BNP acting secretary general Mirza Fakhrul Islam Alamgir for his comment on judiciary.
The apex court told the BNP leader that the judiciary is an organ of the state, not the organ of the government. Everybody should remain cautious in making any comment to ensure that the judiciary is not undermined and its dignity is not damaged, the court said.
The court warning came on Monday after it accepted fresh affidavit explanation of Mirza Fakhrul on his recent comment about the judiciary. A five-member bench of the Appellate
Division of the SC headed by Chief Justice SK Sinha passed the order after disposing of three petitions filed by the BNP leader seeking extension of his bail in three cases.
Mirza Fakhrul at a party meeting in Sylhet on February 7 accused the government of controlling the judiciary. He said, “All the democratic institutions have been destroyed in a planned way. There is no democracy in the country and the judiciary is not independent.”
On February 18, the SC asked the BNP leader to give an explanation about his comment. On February 22, Mirza Fakhrul submitted an affidavit explanation to the court following a Supreme Court order issued earlier. On February 25, the court rejected his earlier submission in this connection and ordered him to submit a fresh one along with newspaper reports by Monday.
In his explanation, Mirza Fakhrul said that he did not make the comment to undermine the judiciary. On acceptance of the explanation, the Supreme Court observed that lawyers and politicians ought not to come up with remarks that can disparage the faith of the people on the judiciary.
Meanwhile, the apex court extended Mirza Fakhrul’s bail for 15 days in the three cases filed for arson and vandalism.
The court also ordered the BNP leader to surrender before the lower court within 15 days.
Additional attorney general Murad Reza stood for the state in the hearing while Barrister Rafiqul Haque and Joynul Abedin argued for Mirza Fakhrul.
Earlier on November 24 last year, the High Court granted three months bail to Mirza Fakhrul in the cases. Two of the cases were filed with Paltan Police Station while another with Motijheel Police Station.
Mirza Fakhrul submitted the three petitions to the apex court seeking extension of the bail order as the tenure of his bail expired on February 24.
