The High Court (HC) on Wednesday commuted the jail term of former BNP Minister Nazmul Huda to four years from seven years on a bribery case filed during the regime of military backed Caretaker Government.
The court also directed Nazmul Huda to surrender in the trial court within 45 days after the trial court
received the copy of verdict, Anti Corruption Commission (ACC) lawyer Advocate Khurshid Alam Khan told the journalists.
Nazmul Huda and his wife Advocate Sigma Huda had taken Tk 2.4 crore from a businessman as a bribe.
On August 27, 2007 a Special Judge Court sentenced Nazmul Huda to seven years imprisonment and Sigma Huda to three years imprisonment.
Trial Court also fined him TK 2.5 crore. ACC lawyer said, fine is remaining as the HC did not say anything about this.
The HC bench of Justice Bhabani Prasad Singha and Justice Mustafa Zaman Islam modified the lower court judgement and sentenced Nazmul Huda to four years imprisonment after hold hearing on appeal petitions filed by Huda couple.
The bench said that Sigma Huda sentence will be considered as served out because she has earlier suffered in jail in this case.
Earlier, another High Court bench had acquitted Nazmul and Sigma from this case. But later, the Appellate Division cancelled the HC judgement and sent the case back to the another HC bench for hearing on merit.
New political party Bangladesh Nationalist Alliance’s (BNA) President Barrister Nazmul Huda took part in the hearing in the court for himself. But he was not present in the court on Wednesday while the court was delivering the judgement.
Advocate Ajmalul Hossain QC was present on behalf of Sigma Huda and Assistant Attorney General Md Bashir Ahmed was present for the state.
ACC’s Deputy Director Md Shariful Islam filed the case on March 21 in 2007 at the Dhanmondi Police Station.
It was said in the case that Nazmul Huda and his wife Sigma Huda took TK 2.4 crore from Mir Zaher Hossain, owner of a leading construction firm, as bribe. The amount was deposited to the Sigma Huda’s account.
A Special Court of Dhaka delivered the judgement on August 27, 2007 in this case.
A High Court bench acquitted Nazmul Huda and Sigma Huda on March 20 in 2011 after hearing their appeal petitions.
Appellate Division on December 01 in 2014 cancelled the judgement of the HC after hearing the appeal petitions by ACC and the State side and sent the case back to the HC for further hearing.
