The Local Government Division (LGD) on Tuesday suspended Erfan Selim from the Ward-30 Councillor post of the Dhaka South City Corporation. The suspension order was issued in the evening.
The order signed by LGD Deputy Secretary ANM Foyzul Haque reads since there is a criminal case filed against him and Erfan is sentenced one year imprisonment by a mobile court, he is suspended according to the Local Government (City Corporation) Act 2009.
Earlier, Dhaka South City Corporation (DSCC) in a letter informed LGED over his imprisonment pointing out media report.
A mobile court of Rapid Action Battalion on Monday sentenced Erfan, son of MP Haji Selim, and his bodyguard Zahidur Rahman to one year in jail for the unlawful possession of arms and liquor at his father’s residence at Devidas Lane of Swarighat in Old Dhaka following a case filed with Dhanmondi Police Station by Lieutenant Wasif Ahmed Khan of Bangladesh Navy for assaulting him.
.According to Section 13 of the Local Government (City Corporation) Act 2009, a mayor or councillor can be suspended on six grounds, including being convicted for moral degradation, misconduct or misuse of power by a court.
Section 12 of the act says the government, through written order, can suspend a councillor or mayor, if legal proceedings are initiated under Section 13 or charge-sheet is given under penal code to a court.
Within three days of suspension, the city Mayor will appoint a neighbour councillor to look after the ward.
