HC's poll-time govt formula: Doing anything beyond Consttn unacceptable, says Law Minister

Staff Reporter :Law Minister Anisul Huq has said any formula for election-time government that is contradictory to the country’s Constitution is unacceptable, and giving such formula is unconstitutional.  He made the statement while speaking at the BBC Bangla Dialogue at Kawran Bazar in the city on Sunday. BNP vice-chairman Abdullah-al-Noman, political scientist Dr Rownak Jahan and Dhaka University Professor Dr Syed Manjurul Islam also took part in the dialogue. The Minister made the comment apparently in reaction to the High Court’s formulas on election-time government. The HC has recently come up with two formulas for the election-time government to assist the Election Commission (EC) in holding the next two Parliamentary elections. “Doing anything beyond the constitution is unacceptable and anti-democratic. If anyone proposes anything that goes against the Constitution, it will be impractical. I don’t believe that the High Court can place any proposal against the Constitution,” he said.  Anisul Huq also talked about the killing of Bangabandhu Sheikh Mujibur Rahman and said that the killing had political involvement. He opined that a Commission could be formed to investigate the political involvement. BNP leader Abdullah-al-Noman also didn’t favour the formulas of the High Court. He said the HC’s formulas and observation on an election-time government is not acceptable, but he commented that the HC through placing the formulas recognised that no fair election is possible under the current government. He opined that the political problem should be resolved politically.A High Court bench had provided the formulas with some observations in its full judgment on uncontested election of 153 MPs in the 10th Parliamentary Elections held on January 5 last year. The full verdict was released last month.In the first formula, the court suggested the formation of a Cabinet for 90 days with 50 Ministers from all political parties. It also suggested that for the sake of an inclusive election, five technocrat Ministers might be taken from the parties which boycotted the election to the present parliament.In the second formula, the court suggested that the winning party would govern the country first for a period of four years and the main opposition party would run the country for the rest one year of the tenure.
