A Cox’s Bazar court has dismissed an appeal by Major (retd) Sinha Mohammad Rashed Khan’s sister Sharmin Shahriar Ferdous to include Cox’s Bazar Superintendent of Police (SP) ABM Masud Hossain as an accused in the case filed over the murder of Sinha.
Cox’s Bazar Senior Judicial Magistrate Tamanna Farah issued the order after a hearing on Thursday afternoon.
Public Prosecutor Adv Faridul Alam confirmed the matter to media.He said: “As the appeal was not consistent with the case, the court rejected it. The court said in this regard that if someone tried to influence the investigation of a case then the investigation officer can take legal action against that person.”
Meanwhile, at a press briefing earlier in the day, the plaintiff’s lawyer Senior Advocate Mohammad Mostafa said: “SP Masud has been obstructing the investigation in the murder of Major Sinha. He even sent a letter to the Cox’s Bazar Jail authority to provide division to the main accused in the murder case, suspended officer-in-charge (OC) of Teknaf police station Pradeep Kumar Das, and suspended inspector Liakat.”
“He is helping the accused in various ways. In other words, Masud is using his official powers in favour of the accused. So I have filed a criminal application to include him as an accused in Sinha murder case,” Mostofa added.
Earlier in the morning, Sinha’s sister Sharmin filed the petition.
Sharmin said SP Masud had been cooperating with the accused indirectly as well as directly since the the incident of murder came to light.
“He has abused his power. He has defamed Major Sinha. At the time, he told the media that he had found yaba tablets and drugs in Major Sinha’s car. He cannot say such things as an SP. He is constantly obstructing the investigation,” she said.
“I expect the court to include SP Masud as an accused in the case in light of these allegations,” Sharmin added.
On the night of July 31, retired army Major Sinha was killed in a police shooting at Shamlapur police check-post on Marine Drive road in Teknaf’s Baharchhara.
Sinha was on his way back to Nilima Resort in Himchhori after filming a video on Marishbunia hill in Teknaf.
On August 5, Sinha’s elder sister Sharmin filed a case with the Cox’s Bazar Chief Judicial Magistrate’s Court against nine people, including Pradeep and Liakat.
