A Chittagong court on Sunday dismissed the appeal filed by former Police superintendent (SP) Babul Akhter seeking permission over filing a case against six officials of Police Bureau of Investigations (PBI), including its chief Banaj Kumar Majumdar.
Besides, the court also rejected another appeal filed by Babul Akhter over his safety in the prison.
Chittagong Metropolitan Sessions Judge Begum Jebunnessa passed the orders.
Earlier, on 8 September, Babul’s lawyer filed a petition in the court seeking permission to file case against six PBI officials on charges of torturing Babul in the prison.
According to the appeal statement, Babul was tortured under the PBI custody in Chattogram between 10 May and 17 May last year though the PBI officials refuted the allegation.
The petition was lodged against PBI chief Banaj Kumar Majumder, its SP Naima Sultana, Chattogram SP Nazmul Hasan, inspectors AK Mohiuddin, Santosh Chakma and Enayet Kabir.
Prosecutor Fakhruddin Chowdhury told the media “The plea seeking permission to file a case has been rejected as Babul claimed that he had been tortured in the remand a year after the incident was occurred.”
He said the charge sheet over killing his wife was submitted in the court. He filed the false plea to divert the case direction.
Mentionable that on September 12, Babul appealed to the court seeking safety for his life in prison alleging that his jail cell in Feni was searched illegally.
Babul alleged that breaching the code of conduct, OC Nizam Uddin of Feni Model police station on September 10 entered his cell with the intent to harm and intimidate Babul following the instructions of the suspects named in that case.
