Contempt of Court Legal notices to 2 Ministers

Supreme Court lawyer Advocate Eunus Ali Akanda on Saturday sent two separate legal notices to Food Minister Qamrul Islam and Liberation War Affairs Minister AKM Mozammel Huq, seeking their explanation in 24 hours on what authority they are holding the post of minister as the Supreme Court observed that they have violated their oath.
Advocate Akanda sent the notices saying that Qamrul and Mozammel have to take fresh oath if they want to hold the posts of the ministry. He would file a writ petition with the High Court Division seeking necessary directives if the two ministers failed to respond the legal notice within next 24 hours.
The SC on Thursday released the full text of the verdict on a contempt of court case saying that the ministers have violated the oath of office.
The eight-strong Appellate Division bench led by Chief Justice Surendra Kumar Sinha on Mar 27 rejected Qamrul and Mozammel’s pleas offering unconditional apologies for their remarks on the Supreme Court hearing war criminal Mir Quasem Ali’s appeal. Top judges found them guilty of the contempt of court and handed down punishment.
The full verdict says, “They have acted in violation of law and are in breach of their oath of office to preserve, protect and defend the Constitution.”
According to a constitutional provision, by taking oath, a minister enters his office to preserve, protect and defend the constitution.
