Chief Justice Syed Mahmud Hossain on Sunday empowered the magistrate courts to hold virtual hearing of the cases under the Negotiable Instrument Act (cheque dishonor cases) and to hold remand hearing of the accused kept in jails through video conference.
Registrar General of the Supreme Court Md Ali Akbar, on Sunday issued a circular to this effect.
Earlier on the day, a legal notice was segued upon the respondents requesting them to frame a clear guideline in filing of cases under the Negotiable
Instrument Act and other time-barred cases under different laws.
Registrar General of the Supreme Court and Secretary of the Bangladesh Bar Council have been asked to comply with the legal notice within 48 hours.
Advocate Mohammad Shishir Manir, a Supreme Court lawyer, sent the notice on behalf of his clients, Sikder Mahmudur Razi and Md Zahirul Islam.
The notice said that the Chief Justice issued special practice directives to operate the subordinate courts and tribunals virtually and only to entertain bail applications of the accused already in custody. But the chief judicial magistrates of the different districts directed their subordinate magistrate courts to register filing of the cases under the Negotiable Instruments Act.
It appears from the initiatives taken by the chief judicial magistrates of the different districts that there is anomalous situation prevalent in the lower administration of justice, according to the legal notice. There is no uniformity of instructions and administrative steps, also added the notice.
In these situation, the respondents are requested to frame guidelines of filing of cases under sections of the Negotiable Instrument Act and other time-barred cases under different laws, the notice also read.
