The Appellate Division of the Supreme Court recently dismissed a leave to appeal petition filed by the government bodies as it was time barred.
Ministry of Social Welfare and the Department of Social Services filed the leave to appeal petition against a High Court order declaring that Advocate Taimur Alam Khondaker was a valid candidate in the Jatiya Badhir Sangstha’s election held in 2016.
A four-member Bench of the Appellate Division headed by Chief Justice Syed Mahmud Hossain delivered the verdict on November 26 this year after holding hearing on the appeal petition.
Advocate Taimur Alam Khondaker and Barrister Mar-e-um Khondaker represented Taimur Alam in the hearing, while Attorney General AM Amin Uddin appeared for the state.
In a press release Advocate Taimur said that his candidacy for the President post in the Jatiya Badhir Sangstha’s election held in 2016 was declared illegal on some allegations. Then he moved to the appeal board of the Social Welfare Ministry for his candidacy and he was rejected.
Finally he filed writ petition with the High Court challenging the cancellation of his candidacy in the election. Upon hearing the petition, the High Court Bench of Justice Quamrul Islam Siddique and Justice Sheikh Hassan Arif on December 11, 2016 declared that Advocate Taimur was a valid candidate in the election of the Jatiya Badhir Sangstha’s in 2016.
Later the Ministry of Social Welfare and the Department of Social Services filed the leave to appeal petition against the High Court order, but the petition was not mentioned for hearing for a long time.
Recently the petition came into the cause-list of the Appellate Division for hearing. After hearing the apex court dismissed the appeal petition.
In a reaction Advocate Taimur said that he had suffered a lot both physically and mentally after cancellation of his candidacy in the election.
He said, “Decision of the Appellate Division proved that the cancellation of my candidacy was a conspiracy by some partisan officials of the Department of the Social Services.”
