Businessman under threat after demanding loan money back

A businessman who lives in a rented house of Pallabi area of the capital city lent some money to the owner of the house when the latter was facing a crisis. The tenant also has the documents of giving loan. Now he is in dire straits as he wants to get his money back. Without returning the money the landlord has claimed that he has done so. This claim has thrown the parties in a bitter conflict.
Recently the landlord with a group of people attacked in the tenant’s flat, looted some assets and gave him threat of dire consequences if he does not leave house as early as possible.
A case has also been filed with the Pallabi Police Station regarding the issue. But a solution has not come yet. Loan giver is suffering from insecurity now.
Humayun Kabir, a leaseholder of Pallabi area in Dhaka, said he had lent Tk 20 lakh to his landlord, Md Hadi, in September in 2018 as Hadi needed the money urgently for registering a plot of land in Savar. He gave the loan through a cheque of Sonali Bank account.
Loan receiver promised to return the amount within two months. But problem surfaced when the loan giver asked the borrower to return the money after two months. In the beginning he (loan receiver) wanted some time to pay back the money. In this way he spent a few months.
At one point Hadi claimed that Humayun Kabir took back the loan amount in several installments from him. Under this circumstance Humayun Kabir filed a general diary (GD) with the Pallabi Police Station on November 23 in 2020 and sought legal support.
Pallabi police tried an alternative dispute resolution and brought the two parties to a face to face interaction. Humayun Kabir produced the banking documents about giving Md Hadi the loan. But Md Hadi failed to produce any document about his claim of repayment of the loan, sources said.
Later on April 25 this year Humayun Kabir filed a case with Pallabi Police Station on charge of looting assets worth Tk 9 lakh including cash money and gold ornaments against Md Hadi and about 11 unnamed persons.
In a written complaint Humayun said that a conflict was continuing between him and Md Hadi over the financial transaction.
In continuation of the conflict Md Hadi along with 11 unknown persons on April 23 went to Humayun Kabir’s house and physically assaulted the members of his family and looted assets worth Tk 9 lakh including cash money and jewellery items, the written allegation said.
While leaving the house after looting Md Hadi and his cohorts threatened Humayun Kabir to leave the area within a shortest possible time with his family, otherwise the family would face a big loss, the complaint also reads.
Md Hadi said, “The money he gave me in September 2018 through a cheque is the money which he borrowed from me. Now he is claiming to have lent me the money. That’s a lie.” Now he doesn’t pay the house rent often and quarrels with me when I ask for it, added Md Hadi.
Pallabi Police Station confirmed the filing of the case by Humayun Kabir and said they were investigating the same.
Acknowledging the allegation and counter-allegation of the two parties Kazi Wazed Ali, Officer in Charge of the Pallabi Police Station, said he had tried to solve the problem. But there was no solution as everyone was adamant in their statements over their claims.
Humayun Kabir has a document of deposing the money in the account of Md Hadi, he said.
