The High Court on Thursday ruled that Tufan Sarkar, a suspended Sramik League leader from Bogura, cannot seek bail from any court of the country for next six months in a corruption case filed against him for committing fraudulence with the High Court.
Tufan Sarkar committed forgery with the HC by submitting a fresh bail petition before it although a rule over this issue was remaining pending at the same court, said Deputy Attorney General Sarwar Hossain Bappy who appeared in the court for the State.
The Anti-Corruption Commission (ACC) filed the corruption case with Bogura Sadar Police Station on December 31, 2018 against Tufan Sarkar, who came to limelight after a rape incident committed on a college girl and shaving heads of both the victim and her mother in Bogura.
The corruption case against Tufan Sarkar, now in jail, was filed for amassing wealth of Tk 15.9 million illegally.
Sarwar Hossain Bappy said filing a fresh bail petition with the HC while a rule, issued by the same court earlier on the same case, was remaining pending is a forgery.
Following another bail petition previously filed by Tufan Sarkar, the HC bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman on September 9 last year issued the rule asking the ACC and the state to explain as to why Tufan Sarkar should not be granted bail in the case.
Tufan Sarkar submitted the fresh bail petition to the same bench on March 9 through lawyer Md Shah Alam Sarker suppressing the information of the pending rule issued on September 9 last year.
The HC bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman on Thursday rejected both the bail petitions of Tufan Sarkar and ruled that he cannot seek bail from any court in this case for next six months for committing fraudulence by suppressing information of pending rule.
During the hearing on Thursday, Tufan Sarkar’s lawyer Shah Alam Sarker apologized to the HC bench and said ‘sorry’ for submitting the fresh bail petition for Tufan Sarkar in the case.
Lawyer Shah Alam Sarker said he did not know about the rule issued by the HC earlier over granting bail to him. “None of Tufan Sarkar and his family members did not inform or give documents to me about the rule,” he added.
The HC bench, however, pardoned lawyer Shah Alam Sarker after accepting his apology.
Tufan Sarkar came to the limelight after he had abducted a student from her home, raped her and then asked his party cadres to make sure it was a secret on July 17, 2017, according to media reports.
In their attempt to silence the victim, they picked up the student and her mother, tortured them for four hours and then shaved their heads, the reports said.
