SC judges "˜misbehaviour': Bill defining probe process to be placed in JS

A bill defining the process of investigation into the allegations of ‘misbehaviour’ or ‘incapacity’ of Supreme Court judges will be placed in the upcoming budget session of parliament beginning on June 1.
Suranjit Sengupta, Chairman of the Parliamentary Standing Committee on Law, Justice and Parliamentary Affairs Ministry, on Tuesday said the ministry has already drafted the bill to enact a law in line with the 16th constitution amendment.
“The bill will be placed in the upcoming budget session after discussing it with all concerned,” he told reporters after a meeting of the parliamentary committee at the Jatiya Sangsad.
On September 17 last, Parliament unanimously passed the ‘Constitution (16th Amendment) Bill, 2014’ without any opposition, empowering Parliament to remove the Supreme Court judges on the ground of proved misbehaviour or incapacity.
Suranjit said the 16th amendment to the constitution will be futile until the law is enacted. As per the latest amendment to the constitution,
Parliament may regulate the procedure for investigation and the proof of ‘misbehaviour’ or ‘incapacity’ of a judge, he added.
He, however, said the parliamentary committee has not received the copy of the draft bill yet. “When the bill (draft) reaches us, we’ll review it.”
According to article 96 (2) of the constitution that was restored with the 16th amendment bill, “A Judge shall not be removed from his office except by an order of the President passed pursuant to a resolution of Parliament supported by a majority of not less than two-thirds of the total number of members of Parliament, on the ground of proved misbehaviour or incapacity.”
The parliamentary committee in its 15th meeting discussed the unusual delay in disposal of the August-21 grenade attack case, said a handout.
The parliamentary watchdog was informed that large number of witnesses is causes for the delay in trial process of the August-21 grenade attack case and the case is expected to be disposed of within the next three months.
The committee suggested quick disposal of the case.
Chaired by Suranjit Sengupta, the meeting was attended by its members Law Minister Anisul Huq, Tajul Islam Choudhury, Shamsul Haque Tuku, Abdul Majid Khan, Talukder Md Yunus and Safura Begum.
