Barrister Mainul Hosein has not been given Division yet in the central jail though he was a former Member of Parliament and Adviser of a Caretaker Government.
He was detained from Dhaka’s Uttara last Monday.
“It’s a matter of regret that Barrister Mainul Hosein has not been given division yet though he is supposed to get the facility as per the jail code,” Khandker Mahbub Hossain, a counsel for Mainul Hosein brought the allegation while talking to The New Nation on Friday.
He said 18 categories of prisoners, including ex-MP and Minister, are entitled to get Division under the jail code.
“But he (Mainul) has not been given the facility violating the jail code. This is also against the Constitution.”
“Even those who are accustomed to high mode of life they are also entitled to get Division- 1 under the jail code,” Khandker Mahbub said..
Mainul Hosein has been kept in ‘Amdani Ward’ with ordinary inmates and even he has been given food like ordinary prisoners.
According to jail officials, there is no chair or bed for prisoners in the ‘Amdani Ward.’
“Mainul has been suffering from complicated heart and other diseases but the jail authorities have not yet taken any action for his medical care in spite of legal notice given by his lawyers. He should be given the facility immediately considering his health condition,” said Khandker Mahbub Hossain.
He said he would go to the court to secure Mainul’s Division, if not given the facility.
“We’re yet to receive any order in this regard from authorities concerned. As there was no directive from the court or the government as to which status Mainul is entitled to in prison, he has been kept along with the ordinary prisoners in a Ward of the Dhaka Central Jail in Keraniganj,” Jailor Mahbub Alam told The New Nation on Thursday.
Mainul Hosein, a renowned lawyer and publisher of The New Nation, was detained on Monday night after a warrant of arrest was issued against him by the Additional Chief Metropolitan Court in Rangpur in a defamation case.
