SCBA says Judge committed judicial misconduct : It's a bailable case

Supreme Court Bar Association (SCBA) President Advocate Zainul Abedin on Monday demanded immediate arrest and exemplary punishment of those who attacked Barrister Mainul Hosein during bail hearing in Rangpur court.
He also demanded trial of the judge who committed a ‘judicial misconduct’ by not granting bail to Barrister Mainul Hosein in a bailable case.
Advocate Zainul Abedin was speaking at a press briefing, organized by the SCBA, on the Supreme Court Bar premises on Monday in protest against the attack on Barrister Mainul Hosein in the court. SCBA Secretary Barrister A M Mahbub Uddin Khokan and other bar leaders were present on the occasion.
The SCBA president said, “Attack on Barrister Mainul Hosein in Rangpur court was conducted under the shadow of the government and the police. He has been insulted by this attack. But this was not just his humiliation; all the lawyers of the country have also been humiliated. So, we demand immediate arrest and exemplary punishment of the attackers.”
“The apex court is the guardian of the Constitution and the Chief Justice is the guardian of the courts. And the lawyers are called the officers of the courts. So, the Chief Justice has the responsibility to uphold the dignity of the lawyers,” he said.
Advocate Zainul Abedin said, “We will request the Chief Justice that he will take initiative to probe into the incident of attack on Barrister Mainul Hosein on the Rangpur court premises. We will also demand trial of the judge who committed a ‘judicial misconduct’ by not granting bail to Barrister Mainul in a bailable case. Call the Magistrate and take action against him. We want to see that the Judiciary is independent. Otherwise, toughest programme will be thrown.”
Barrister A M Mahbub Uddin Khokan said, “It is the duty of the government to keep secured environment on the court premises. But now court premises are also unsafe. Only big criminals are brought to the court wearing a helmet. But police brought Barrister Mainul Hosein in the court wearing a helmet, though he was an accused of a defamation case. It is shameful for the lawyers.”
“Attack on someone in the court premises is a non-bailable offence. We want to know from the judge of the Rangpur court how a litigant was attacked in the courtyard? Arrest the attackers. We hope, the Chief Justice will look into the matter,” the SCBA secretary said.
Barrister Mahbub announced a fresh programme in demand of the release of Khaleda Zia, Parliament election under a neutral government and in protest against the attack on Barrister Mainul Hosein on the Rangpur court premises. They will observe sit-in programme in all the bar of the country today (Tuesday).
Advocate Zainul Abedin said “SCBA will send a delegation to the Election Commission to defer the date of announcement of the schedule for the 11th Parliamentary election and not to use EVM in the election.”
SCBA Vice-Presidents Golam Mostofa and Golam Rahman Bhuiyan, Barrister A K M Ehasnur Rahman, Advocate Ahsan Ullah and some other pro-BNP lawyers were also present at the briefing.
