The High Court (HC) Division of the Supreme Court on Wednesday fixed August 23 to pronounce the verdict in a case filed challenging Nizam Uddin Hazari’s legality as Parliament Member for his alleged forgery in getting early release from jail.
A HC bench comprising Justice Md Emdadul Huq and Justice Md Iqbal Kabir re-scheduled the date as the documents of the case have not yet reached them from the trial court.
Shakhawat Hossain Bhuiyan, a Jubo League leader from Feni, filed the petition saying that Nizam Hazari freed himself from jail before expirty of the jail terms in an arms case that a Chittagong court sentenced him 10 years’s imprisonment on August 16, 2000.
Nizam Hazari was sent to jail after he surrendered to the lower court on September 14, 2000, but he got released through fraudulence on December 1, 2005.
Shakhawat in his petition stated that Nizam Hazari was supposed to serve in the jail till September 13, 2010, and therefore he could qualify for contesting the Parliamentary election as per the Constitution.
The HC issued a rule on June 8, 2014 asking the government, the Election Commission and Nizam Uddin Hazari to explain under what authority the MP claims to hold the public office concealing information about his early release from jail in the arms case.
The HC asked also the jail authority to inform the court about the details of jail term served by the ruling party MP. The jail authority submitted its report on July 19.
According to the report, Nizam Hazari served five year eight months and 19 days out of 10 years.
Barrister Shafiq Ahmed and Nurul Islam Sujon moved for Nizam Hazari while Advocate Kamrul Haque and Satya Ranjan Mandol stood for the petitioner.
