SC stays process to hold Tangail-4 by-polls till Nov 2

The Appellate Division of the Supreme Court has stayed the process of holding Tangail-4 by-polls, slated for November 10, till November 2.
Chamber Judge of the Appellate Division Justice Syed Mahmud Hossain passed the order on Tuesday after primarily hearing on a petition filed by the Election Commission (EC).
The Chamber Judge also forwarded the matter to the regular bench of the apex court fixing November 2 for the next hearing. Chief Justice SK Sinha will lead the Appellate Division bench.
The EC on Monday filed the petition seeking a stay on a High Court order that asked the commission to allow Abdul Kader Siddique, President of the Krishak Sramik Janata League to contest the Tangail-4 by-polls. Barrister Mohammad Yeasin Khan stood for the petitioner in the court on Tuesday, while Advocate AJ Mohammad Ali and Barrister Ragib Rauf Chowdhury stood for Kader Siddique.
Talking to reporters, Attorney General Mahbubey Alam said that the EC couldn’t proceed with the process for holding the election till November 2 following the SC order. The Appellate Division bench, led by Chief Justice SK Sinha will pass its order after verifying whether Kader Siddique is a loan defaulter or not on November 2, he added. The High Court on October 21 asked the EC to accept the nomination paper of Kader Siddique following a writ petition filed by the leader. The leader filed the writ petition with the HC on October 20 challenging the legality of the cancellation of his nomination to contest the Tangail-4 by-polls.
The Parliamentary seat-133 (Tangail-4) has remained vacant since September 1 after sacked minister Abdul Latif Siddique, elder brother of Kader Siddique, quit his Parliament Membership following his controversial remarks about Hajj and Prophet Muhammad (sm). Latif Siddique had also been expelled from the Awami League for the remarks. Once, Kader Siddique was also an Awami League MP from Tangail.
On October 11, Kader Siddique, his wife Nasrin Siddique and two other leaders of the party submitted nomination papers to contest the by-polls. The authorities scrapped the nominations of Kader Siddique and his wife on loan default charges on October 13, a day after getting a fax from the Credit Information Bureau of Bangladesh Bank. According to the fax, Kader Siddique’s firm `Sonar Bangla Engineering` is a loan defaulter for failure to repay the Tk 10.88 crore taken from Agrani Bank. Nasrin Siddique is a director of the organisation. The Siddique spouses moved the EC against the cancellation of their nominations, but their pleas were rejected after a hearing on October 18. A five-member panel, headed by Chief Election Commissioner Kazi Rakibuddin Ahmad, dismissed the appeals. Kader Siddique then appealed to the High Court.
