The Supreme Court has upheld the three-year jail sentence of former Awami League minister Dr Mohiuddin Khan Alamgir’s son Joy Alamgir in a corruption case.
The Appellate Division of the SC on Thursday scrapped the High Court’s verdict that had acquitted Joy and MK Alamgir’s another son of graft charges. The apex court, however, exempted another son-Jalal Alamgir-of the case, as he has died.
A four-member bench of the Appellate Division headed by Chief Justice SK Sinha passed the order disposing of a petition filed by Anti-Corruption Commission (ACC), challenging the HC verdict.
The SC said that Joy Alamgir could move an appeal before the HC against the lower court verdict that had sentenced him to a three-year imprisonment, said ACC’s lawyer Syed Mamun Mahbub.The lawyer also said that the SC considers Joy Alamgir as a fugitive and the proceedings against him will continue, while his brother Jalal Alamgir, who died in 2011 in Thailand, was exempted from the case. The court has ordered Joy to surrender in the trial court, he added.
The two brothers were tried in absentia in a special court, set up on the Jatiya Sangsad premise on November 5 in 2008. The special court sentenced the ruling party leader and former home minister MK Alamgir’s two son to three years in jail for not filing their wealth statements to the ACC. They were also fined Tk 5 lakh in default to suffer one-year jail more.
Following two separate writ petitions filed by MK Alamgir, the HC on February 15 in 2010 declared the lower court judgement illegal and acquitted his two siblings of the charges.
The ACC later filed an appeal with the SC challenging the HC verdict. The ACC filed the case with Gulshan Police Station on June 26 in 2008.
