Medical reports are not mandatory in rape cases and punishment can be given taking the surrounding situation and depositions of witnesses into consideration.
A High Court bench headed by Justice Rezaul Huque passed an order in this regard on Wednesday.
At the same time, the court said if a victim files a case lately, it cannot be called a false case.
In the definition of rape case, it is clearly stated that

In the definition of rape case, it is clearly stated that
the accused cannot be given punishment in any way without medical report. Medical report is therefore one of the tools to prove rape cases.
But the High Court on Wednesday ruled that punishmrent in rape cases can be awarded without taking the medical report in cognizance.
On Tuesday, the president signed an ordinance fixing the death penalty as maximum punishment for rape from the previous maximum punishment of life sentence.
