The High Court on Thursday directed the Law Ministry to keep District and Sessions Judge of Narail Sheikh Abdul Ahad away from discharging judicial activities in criminal cases for one year for exempting the principal accused of a murder case.
The HC bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman passed the order while hearing a petition filed by one Nazmul Huda seeking necessary order against Sheikh Abdul Ahad.
Nazmul is the brother of one Enamul Haque who was shot dead at Barnail Bazar area under Kalia Police Station in Narail on February 10, 2015.
Nazmul had also filed the case with Kalia Police Station against 68 persons including Mallick Majharul Islam alias Maza. In the case statement, he said that Mallick ensured the death of his brother Enamul by firing three bullets into his body.
On June 10 this year, Narail District and Sessions Judge Sheikh Abdul Ahad accepted the charge sheet of the case from which the name of Mallick was dropped.
Later, Nazmul filed the petition with the HC challenging the district and Sessions judge’s order, where he prayed to the HC to order the trial court judge to include Mallick in the case.
In continuation of the petition, the HC on July 7 ordered Judge Abdul Ahad to explain as to why his judicial power should not be curtailed for exempting Mallick from the murder case. On July 10, Sheikh Abdul Ahad sent a letter to the HC offering unconditional apology to the court for exempting Mallick from the case.
