BNP’s mayor runner Hasan Uddin Sarkar on Monday filed a petition with the Supreme Court seeking a stay order on the High Court’s decision that halted Gazipur City Corporation election.
As an aggrieved person, he filed the writ petition.
Chamber Judge of the Appellate Division fixed Tuesday to hold hearing on the petition, Barrister Sanzid Siddique, a lawyer for Hasan Uddin Sarker told The New Nation.
On the other hand, Awami League mayoral candidate Jahangir Alam also decided to file a petition with the SC on the same ground, his lawyer S M Shafiqul Islam said.
Citing from the petition, Sanzid Siddique said the High Court stayed the Gazipur City Corporation election for three months on Sunday following a writ petition filed by Savar Upazila Awami League leader A B M Azharul Islam alias Suruj, who is not an aggrieved person about the Gazipur City Corporation election. Therefore, his writ petition is not acceptable.
Barrister Sanzid also said that the writ petition was filed with the HC from political intention in order to obstruct the process for holding the Gazipur City Corporation polls.
Sources said, Awami League mayoral candidate Jahangir Alam came to the SC on Monday evening to file a petition against the HC order.
He told journalists, “I want the Election anyway in the interest of the Gazipur City Corporation. We want to do democratic exercise. I seek cooperation from all in the interest of Gazipur City Corporation. So, I have come to file petition against the High Court order.”
Jahangir Alam’s lawyer S M Shafiqul Islam said, they had decided to file appeal against the High Court order and the process was ongoing.
The High Court on Sunday stayed the Gazipur City Corporation polls for three months which was scheduled to be held on May 15.
The court also issued a rule asking the Election Commission and the government to explain as to why inclusion of six mouzas of Shimulia Union Parishad of Savar should not be declared illegal.
The HC bench of Justice Naima Haider and Justice Zafar Ahmed passed the order.
Gazipur City Corporation election was scheduled to be held on May 15. Chief Election Commissioner KM Nurul Huda announced the election schedule for Gazipur and Khulna City Corporations on March 31.
