The High Court has directed the provisional liquidator of the People’s Leasing and Financial Services Limited (PLFSL), a non-bank financial institution, to trace out the present addresses of the 134 borrowers as they could not be found in their recorded addresses during issuing the last summon letter of the court.
The court asked the provisional liquidator to take help from the law enforcing agencies to trace out the addresses of the borrowers.
The liquidator has also been asked to send the HC summon in their present addresses for appearing before the court on the next hearing date.
The HC bench of Justice Muhammad Khurshid Alam Sarkar passed the order on March 9 this year after hearing on a case filed by provisional liquidator of the PLFSL Md Asaduzzaman Khan.
The HC bench in November last year sought a list of the loan defaulters from the provisional liquidator of the PLFSL, a non-bank financial institution which is on the process of winding up.
Then the provisional liquidator of the company submitted a list of 280 borrowers before the HC bench on November 23.
After holding hearing on the list the HC on January 20 summoned 280 loan defaulters of PLFSL and directed them to appear before the court on February 23 and 25 to place their explanations on this issue. Six defaulters were added in the list later.
Complying with the court order 152 borrowers appeared in the court on February 23, 25 and March 9 this year. But 134 borrowers didn’t appear.
Sources said, special messenger informed the HC that 134 borrowers could not be found at the giver addresses which were provided during receiving the loan from the organization.
After considering the information placed by the special messenger, the court ordered the provisional liquidator to trace out the present addresses of the borrowers by taking help from the law enforcing agencies.
Meanwhile, the HC on last Tuesday asked the borrowers of the PLFSL who appeared before the court complying with its order to put a down-payment within next 15 days.
The court at the same time asked the borrowers to submit a planning on how they would pay the remaining amount.
Five borrowers on that day deposited Tk 2.4 million to the PLFSL through check, said Barrister Mejbahur Rahman who took part in the hearing of the court on behalf of the provisional liquidator of the PLFSL.
